AGREEMENT TO TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "your") and FoodYouMe LLC, doing business as Platebook ("we," "us," or "our"), governing your access to and use of the website located at https://platebook.co and any related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Services.

ELIGIBILITY

You must be at least 18 years of age or the equivalent minimum age in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet this age requirement.

DESCRIPTION OF SERVICES

Platebook is currently in a pre-launch phase. The Services currently consist of:

  • An informational website describing the Platebook meal planning tool
  • A waitlist registration where you may provide your email address to receive updates
  • A survey to provide feedback on meal planning needs

Joining the waitlist does not guarantee access to any future product, nor does it create any obligation on our part to deliver a product or service on any particular timeline.

WAITLIST AND COMMUNICATIONS

By submitting your email address through our waitlist form, you consent to receive communications from us related to Platebook, including product updates, launch announcements, and occasional marketing messages. You may unsubscribe from these communications at any time by clicking the unsubscribe link included in each email or by contacting us at hello@platebook.co.

SURVEYS AND FEEDBACK

Any responses, ideas, suggestions, or feedback you provide through our surveys or other communications ("Feedback") are provided voluntarily. By submitting Feedback, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and incorporate such Feedback into our products and services without any obligation of compensation or attribution to you.

INTELLECTUAL PROPERTY

All content on the Services, including but not limited to text, graphics, logos, images, and software, is the property of FoodYouMe LLC or its licensors and is protected by United States and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Services without our prior written consent.

The name "Platebook," the Platebook logo, and all related names, logos, and slogans are trademarks of FoodYouMe LLC. You may not use these trademarks without our prior written permission.

ARTIFICIAL INTELLIGENCE

Our Services may incorporate features powered by artificial intelligence, machine learning, or similar technologies provided by third-party service providers, including Anthropic and Google Cloud AI. Your use of AI-powered features is subject to these Terms and our Privacy Policy. You acknowledge that AI-generated outputs may not always be accurate and should not be relied upon as a substitute for professional dietary, medical, or nutritional advice.

PROHIBITED USES

You agree not to use the Services to:

  • Violate any applicable law, regulation, or these Terms
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to any part of the Services or related systems
  • Use automated means (bots, scrapers, or similar tools) to access the Services without our written consent
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the Services

DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

PLATEBOOK IS A MEAL PLANNING TOOL AND DOES NOT PROVIDE MEDICAL, DIETARY, OR NUTRITIONAL ADVICE. THE SERVICES ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE MAKING DIETARY CHANGES, ESPECIALLY IF YOU HAVE A MEDICAL CONDITION.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOODYOUME LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FoodYouMe LLC and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services or your violation of these Terms.

THIRD-PARTY LINKS

The Services may contain links to third-party websites or services, including survey platforms. We are not responsible for the content, privacy practices, or terms of any third-party websites. Your use of third-party websites is at your own risk and subject to their respective terms and policies.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in the State of New York, and you consent to the personal jurisdiction of such courts.

CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FoodYouMe LLC regarding the Services and supersede all prior agreements and understandings.
